Honda to Recall 46,000 Odyssey Minivans on Door Flaw Causing Injury - Dallas, Texas

Honda is recalling almost 46,000 Odyssey minivans on concerns that the vehicles' rear doors may be defective and pose a risk to passengers, the National Highway Traffic Safety Administration said Wednesday.

Honda will recall 45,747 of the model year 2008-2009 vehicles, the agency said.

The gas-filled struts on rear doors, which help to raise the liftgate of Odyssey vehicles that have a power liftgate system, "may be prone to early life failures due to a manufacturing flaw," the agency said, which can lead to "reduced performance."

"Struts with diminished performance can lead to unexpected closure, increasing the risk of personal injury," the agency said.

Honda said the problem has caused two minor injuries. The company will replace both power liftgate struts on affected vehicles for free.

A jury awarded $3 million to a woman who claimed that she suffers from complex regional pain syndrome as a result of a rear-ender. In 2006, Lynn Oppedisano, then 43, was rear-ended by Jeffrey Utz. The court directed a liability verdict against Utz at trial. Oppedisano presented to a chiropractor 10 days after the accident, complaining of "cascading pain." She was eventually diagnosed with CRPS by a neurologist. Oppedisano underwent intensive Ketamine treatments that required heavy sedation. Doctors expect that these treatments will continue for the rest of her life. She still complains of persistent pain. Utz disputed the diagnosis and denied its relation to the collision, although the defense expert acknowledged some CRPS symptoms.

The family of a young woman who fatally crashed into a light pole after a night of drinking recovered a little more than $1 million. In 2006, Brynne A. Schuenemann, 23, went to Dreemz in Philadelphia with friends. Before they arrived, Schuenemann had a couple of drinks. She drank two vodka cocktails and then switched to beers. Her friends claimed bartenders continued to serve her beers even though she was "loud, a little obnoxious" and "off balance." She drank there until closing time at 2 a.m. Her blood alcohol level was 0.224. The plaintiff's toxicology expert testified that she consumed at least eight to nine beers and would have exhibited visible signs of intoxication. The jury found Schuenemann 49 percent liable, which reduced its $1.9 million award.

A woman who was diagnosed with a concussion a month after a rear-ender was awarded $82,817. In 2004, Terri Burt, then 34, was rear-ended in a parking lot as she was exiting. She sought an underinsured motorist claim with her carrier, State Farm, which disputed the value of her underinsured motorist claim. She then sued her insurer for breach of contract. Burt claimed a head injury, as well as bulges in the cervical spine which continued to cause her constant pain, she said. She was diagnosed with a concussion a month after the accident, and said she never fully recovered from it. She claimed occasional dizziness, nausea, headaches and memory loss.

Ford Hit With Verdict For SUV Rollover Accident Resulting In Paralyzed Driver - Dallas, Texas

 

A single mother who was paralyzed in a rollover crash recovered more than $21 million from Ford Motor Co. In 2007, Cynthia Castillo was driving a 1997 Ford Explorer on the interstate in Riverside County when the tread separated on the left rear tire. This caused her to veer off road, roll several times and finally hit a tree. Castillo fractured her spine and was rendered a quadriplegic. She receives 24-hour nursing care that she'll need for the rest of her life. She and her young daughter currently live with Castillo's parents. Castillo claimed that the rear axle and placement of shock absorbers caused it to tramp and skate, which led to a loss of control as the rear tire detreaded. Her counsel claimed internal memos showed Ford was aware of this condition, but they were ignored by Ford management. The jury found Ford 91.5 percent liable, which reduced the $23.4 million award.

The defense challenged both the nature and severity of the plaintiff's damages by pointing out he had a cervical fusion surgery 13 years before the accident.
