A man who sustained a traumatic brain injury when he fell off the gate of a truck's trailer agreed to a $3.5 million settlement. In 2009, Carol McKee, then 58, was helping unload commercial freezer components from an ABF Freight System Inc. trailer. An HVAC technician, McKee was replacing a walk-in refrigeration unit. McKee struck his head on the pavement. Plaintiff's counsel maintained that ABF shouldn't have allowed him on the gate lift when it was elevated. He was hospitalized for two months and in rehabilation for another three. He can no longer work as an HVAC technician.

Elderly Man Recovers for Slip and Fall on Church Property - Dallas, Texas

An elderly man who claimed that he fell when he stepped into a hole on the grounds of a Galveston church recovered $140,475. In 2007, Harvie Collins, then 84, fell on property owned by the Compton Memorial Church of God in Christ. He injured his hip and eventually underwent hip replacement surgery. The church claimed that the alleged hole was not involved in the accident and the condition of the property was not unreasonably dangerous. The jury found the church 75 percent liable and Collins 25 percent liable. It awarded $187,301.29, which was reduced to $140,475.98.

Man Recovers For Paralyzing Football Injury Including Broken Neck - Dallas, Texas

A Manhattan man recovered $8 million for a paralyzing injury that he sustained during a football game in New York's Public Schools Athletic League. The payment settled a lawsuit that was filed by Blake Hunt. In 2007, Hunt, then 17, broke his neck while tackling another teen in a PSAL football game. He suffers quadriplegia and resides in a nursing home. Hunt claimed that the league negligently allowed him to participate in the game despite his having missed five of the required 11 practices, during which players learn proper tackling techniques. The defendants contended that Hunt had been well-coached and that his injury was a natural consequence of the game of football. During the trial, the parties agreed to settle the case.

Paralyzed Woman Recovers For Faulty Lift System - Dallas, Texas

A judge awarded $561,084 to a paralyzed woman who broke both hips when the sling on her lift system broke. In 2008, Adelaide Mealy, who had lower extremity paralysis since 1952, was being moved in a Guldmann Lift System when one of the four straps on the system's polyester sling broke. Mealy fell to the floor, sustaining bilateral hip fractures. She sued Guldmann Inc. and B-Mobile Inc., which sold and installed the system, alleging the sling wasn't manufactured to the desired specifications and that its straps were sewn with defective thread. The defendants argued that the sling was modified after installation by someone else. They also contended that many of Mealy's injury complaints were preexisting from a previous fall.

Burn Victim Recovers For Injury Due to Welding Torch - Dallas, Texas

A college student who was burned in a welding class agreed to a $375,000 settlement. In 2007, Paul Manley, then 22, was taking the introductory class at LeTourneau University. Manley was holding a welding torch when he inadvertently caught his shirt on fire, sustaining second and third-degree burns. Manley sued LeTourneau University, claiming the university did not require its students to wear leather upper body protection. He sustained the burns on the right side of his chest. He'll eventually undergo laser revision surgery.

Boy Killed By Dog Attack is Awarded 7M By Jury - Dallas, Texas

A jury awarded a little more than $7 million to the family of a boy who was killed when he was attacked by two dogs while riding his skateboard. In 2009, Justin Clinton, 10, was riding his skateboard past the rear of a home owned by Ricky and Christy George when he was attacked by their dogs, a pit bull mix and an American Bulldog. His attorneys argued the Georges were aware that they had previously attacked people and the fence in their yard was poorly maintained. Plaintiffs' counsel said Justin was conscious for five to 15 minutes during the attack and bled to death 30 to 45 minutes later from multiple bites to his head, neck, torso and legs.

Plumber Settles Over Death Caused by Fatal Fire - Dallas, Texas

A Brooklyn-based plumbing contractor agreed to pay $982,200 to the family of a woman who died in a fire that was blamed on a repairman's error. The payment settled a lawsuit that was filed by the children of Norma Heisler, who died as a result of a fire in her home. Heisler smelled smoke soon after one of National Plumbing & Heating Corp.'s plumbers had worked in her home. She reported the problem, but the plumber believed he could address it the next day. Hours later, Heisler's home was in flames. Heisler's family contended that the smoky smell required immediate attention, but National Plumbing & Heating blamed Heisler, contending that she was told to report back to the company if the problem persisted, but that she instead went to sleep.

Hospital Found Liable For Fraud In Treatment of Patient - Dallas, Texas

A jury awarded $2 million to the widow of a man who claimed that a hospital fraudulently obtained consent to do an autopsy in its facility. In 2004, Jerry Carswell, 61, died at St. Catherine Hospital in Katy. His wife claimed the nurses failed to monitor him after he was given painkillers, which led to his death, and then hospital officials talked her into having the autopsy performed there instead of going to a private pathologist. Years later the family learned that Carswell was buried without his heart. The jury found that that the hospital was not negligent in its treatment and had not interfered with the right to internment. However it found that the defendant committed fraud and breached its fiduciary duty.

Worker Exposed to Asbestos Resulting in Mesothelioma Wins At Trial - Dallas, Texas

A building contractor who claimed years of asbestos exposure resulted in mesothelioma recovered $6.5 million from Union Carbide. William Aubin was 57 when he was diagnosed with the cancer. He claimed that his first exposure to asbestos was when he was a high school student when he began building homes with his father. He claimed that several companies were negligent, but that Union Carbide was especially liable for supplying the asbestos and failing to warn of its dangers. Defense counsel disputed that Union Carbide's type of asbestos caused the mesothelioma. The company also argued that it had no duty to issue warnings because the supply manufacturers were already warned about the health concerns. The jury disagreed and found Union Carbide 46.25 percent liable, which reduced its $14.1 million award.

Injured Worker Wins At Trial For Electrical Burns and Pain - Dallas, Texas

A laborer who was severely burned by an electrical box was awarded $7.7 million. In 2007, Marco Murillo, then 32, was salvaging copper cables from electrical boxes at a demolition site. Murillo was working on one of the last boxes to be dismantled when he was severely burned on both hands and forearms. Oncor Electric Delivery was responsible for de-energizing the boxes. Murillo underwent skin grafts and had back muscles transferred to his forearms and nerves transferred from his ankles into his forearms. Oncor was found 60 percent liable and three other defendants were found 40 percent liable. Oncor is responsible for the entire award.
